PALU – Proses tender di lingkugan Satuan Kerja Bandar Udara Mutiara di Palu dengan Agency Direktorat Jenderal Perhubungan Udara, yang bersumber dana APBN 2016 lalu diduga dimenangkan perusahaan yang sudah diblacklist atau masuk daftar hitam di Portal Pengadaan Nasional LKPP.
Berdasarkan tayang website LPSE Kementerian Perhubungan RI, dimana paket yang dilelang yakni paket Pekerjaan Timbunan Tanah di Area Runway Strip, Pembuatan Saluran Terbuka, Pemasangan Pagar Pengaman Type A di Area Sisi Udara, 1 Paket (Lelang Tidak Mengikat) dengan kode lelang : 28916114 dengan nilai Harga Perkiraan Sendiri (HPS) Rp 69.955.000.000, yang dilelang sejak pengumuman tanggal 9 Desember 2015, atau penandatangan kontrak tanggal 7 Januari 2016 itu, dimenangkan perusahaan PT Karya Bangun Mandiri Persada dengan nilai penawaran harga Rp 66.456.800.000 atau 94,99 persen.
Dalam pengumuman penetapan pemenang, PT Karya Bangun Mandiri Persada (PT KBMP), juga tercantum alamat perusahaan yang beralamat di Graha KBMP Jl. RA. Kartini No. 42 Rawapanjang – Bekasi (Kota) – Jawa Barat dengan NPWP: 02.276.102.7-432.001.
Dan sesuai Perka LKPP Nomor 18/2014 tentang Daftar Hitam Dalam Pengadaan Barang/Jasa, yang merupakan perubahan dari Peraturan Kepala Lembaga Kebijakan Pengadaan Barang dan Jasa Pemerintah (LKPP) No: 7 Tahun 2011 tentang Petunjuk Teknis Operasional Daftar Hitam yang menegaskan: Daftar Hitam adalah daftar yang memuat identitas Penyedia Barang/Jasa yang dikenakan sanksi oleh Pengguna Anggaran/Kuasa Pengguna Anggaran berupa larangan ikut serta dalam proses pengadaan barang/jasa di seluruh Kementerian/Lembaga/Satuan Kerja Perangkat Daerah/lnstitusi lainnya selama dua tahun.
Namun, aturan Perka LKPP tersebut rupanya tidak diindahkan oleh Satuan Kerja Bandara Mutiara, Palu, Sulawesi Tengah, Ditjen Perhubungan Udara, Kementerian Perhubungan RI dengan penetapan pemenang yaitu perusahan telah di-blacklist atau masuk daftar hitam.
Saat proses lelang yang diikuti 19 peserta, dan yang memasukkan penawaran harga hanya dua peserta yakni PT Karya Bangun Mandiri Persada (PT KBMP) dengan penawaran harga Rp 66.456.800.000 dan PT Dharma Perdana Muda dengan penawaran Rp 68.557.000.000. Kedua perusahan yang memasukkan penawaran harga ini diduga dikendalikan atau diusung satu orang peserta lelang, sedangkan perusahaan diduga dirental atau pinjam bendera.
Penetapan pemenang oleh PT. KBMP pada paket Pekerjaan Timbunan Tanah di Area Runway Strip, Pembuatan Saluran Terbuka, Pemasangan Pagar Pengaman Type A di Area Sisi Udara, 1 Paket (Lelang Tidak Mengikat) oleh Satker/Pokja dicantumkan juga domisili yang beralamat di Graha KBMP Rawapanjang, Bekasi, dan NPWP yang bernomor: 02.276.102.7-432.001. Yang menjadi pertanyaan, bahwa perusahan pemenang telah daftar hitam di Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah (LKPP).
Berdasarkan data atau detail di LKPP, bahwa perusahaan PT Karya Batam Mandiri Perkasa dengan Nomor Pokok Wajib Pajak (NPWP): 02.276.102.7-432.001, dan domisili di Jl. Pelabuhan Ratu Blok A5 No. 2 Bumi Baru, Kota Bekasi telah masuk daftar hitam di LKPP terkait proyek SK, PA Dinas Pengelolaan Sumber Daya Air Prov Sumatera Barat No: 019/SK.PSDA/I/2015, dengan alasan: Perka No. 18/2014 Pasal 3 ayat 2 Huruf f: Tidak dapat menyelesaikan pekerjaan sesuai dengan kontrak secara bertanggungjawab, mulai berlaku tanggal 26 Jan 2015 – 25 Jan 2017 dengan tanggal tayang 05 Februari 2015.
Sedangkan proses lelang paket Pekerjaan Timbunan Tanah di Area Runway Strip, Pembuatan Saluran Terbuka, Pemasangan Pagar Pengaman Type A di Area Sisi Udara, 1 Paket tersebut telah berjalan pertengahan Desember 2015 hingga tanggal kontrak 7 Januari 2016, sedangkan masa blacklist nya berlaku tanggal 26 Jan 2015 – 25 Jan 2017, dan bahkan sebelumnya juga perusahan ini sudah di-blacklistdengan masa berlakunya per tanggal 30 Des 2013 – 29 Des 2015.
Anehnya, perusahaan yang di-blacklist PT Karya Batam Mandiri Perkasa, yang kemungkinan besar diduga oleh pemilik atau pengurusnya agar bisa beroperasi lagi hingga diganti menjadi PT Karya Bangun Mandiri Persada.
PT Karya Batam Mandiri Perkasa atau PT Karya Bangun Mandiri Persada (PT KBMP), yang sepandai-pandainya pemilik perusahan merubahnya, namun sayang soal NPWP tidak dirubah.
Nama perusahaan yang dirubah memang samar-samar, yakni serupa tapi sama dan sepintas lalu bila diperhatikan tidak ada perubahaan, namun yang satu inilah yakni NPWP yang bernomor : 02.276.102.7-432.001 tetap sama digunakan.
Nomor Pokok Wajib Pajak inilah yang membawa jelas, yang menandakan perusahaan telah di-blacklist, dan terkesan sepintas bila diperhatikan bahwa yang diganti Batam menjadi Karya dan Perkasa diganti menjadi Persada, yang mana tidak ada yang tahu-menahu, atau pihak Satker/Pokja apakah pura-pura tidak tahu atau tahu? Atau pemilik perusahaan dengan sengaja atau ada istilah, “bila lolos, tentu aman, bila ketahuan tentu tak apa-apa, toh juga namanya tender dan berhasil menjadi pemenang”.
Bahkan, ketika media ini menulis berita tentang perusahaan tersebut pada proyek lain di Kementerian PUPR dua minggu setelahnya, terajdi keanehan yang patut dipertanyakan kepada LKPP. Keanehan itu yakni daftar hitam KBMP yang tercantum di LKPP tidak muncul. Kemungkinan, daftar itu dicabut, dan entah siapa yang mencabut, apakah pihak LKPP atau ada oknum LKPP yang turut bermain, padahal masa waktu blacklist sampai 2017.
Begitu pula, data yang diperoleh dari Lembaga Pengembangan Jasa Konstruksi (LPJK NET), bahwa sejumlah pengalaman atau kemampuan dasar PT Karya Batam Mandiri Perkasa menjadi berubah milik PT Karya Bangun Mandiri Persada.
Buktinya, perusahaan ini (PT KBMP) ketika mengikuti lelang pada akhir Maret 2016 di lingkungan Kementerian Kesehatan (Satker RS Jantung Harapan Kita) pada paket Pembangunan Gedung Utility, malah digugurkan dengan alasan bahwa dipersyaratan dalam dokumen lelang yakni pengalaman sejenis atas nama PT Karya Batam Mandiri Perkasa, bukan atas nama PT Karya Bangun Mandiri Persada, sehingga tidak dapat dihitung Kemampuan Dasar (KD) untuk pengalaman sejenis.
Menanggapi hal itu, Ketua Umum LSM Lapan (Lembaga Pemantau Aparatur Negara), Gintar Hasugian menilai, bila benar perusahaan telah di-blacklist selama periode dua tahun, dan masih berlaku, sementara perusahaan ikut tender bahkan sebagai pemenang, maka hal itu harus diusut tuntas.
“Aneh, kok bisa perusahaan sudah daftar hitam di LKPP, masih bisa sebagai pemenang, ini sudah pasti diduga ada konspirasi antar Pokja/satker dengan perusahan pemenang, atau bahkan diduga bahwa perusahaan pemenang kemungkinan merupakan “perusahan rental”, yang mengusung adalah oknum atau pihak tertentu, dan hal ini harus diperhatikan Menteri Perhubungan. Ini sebagai info agar Menteri segera merespon dan menindak tegas anak buahnya yang bermain lelang di lingkungan Ditjen Perhubungan Udara,” ujarnya ketika dikonfirmasi belum lama ini.
